Terms of Service
1. Scope
These general terms and conditions (hereinafter "GTC") apply to all contracts, deliveries and services of schwups GmbH (hereinafter "supplier") to its customers (hereinafter "customer").
The provider reserves the right to change these conditions at any time. The amended GTC will be published on the osthost.ch website and will come into effect when it is activated.
2. Conclusion of contract
The customer can request the offer from the provider via the online order form on the website of the provider or by e-mail. By submitting the completed order form, the customer submits a binding offer to conclude a contract. The provider will immediately confirm receipt of the customer's offer. The offer is accepted by the provider either through written confirmation or through the provision of the ordered services.
3. Services
The provider makes the booked hosting service available to the customer in accordance with the contractual agreements.
4. Customer Obligations
Scripts that consume a lot of resources and affect the stability of the server are not allowed. The provider reserves the right to set limit values for resource consumption and, if the customer account impairs server operation, to throttle or block its performance if necessary.
The Provider reserves the right to disable customer accounts to ensure the security and integrity of the servers. e.g. B. If they are used to send spam or if malicious code is detected on their websites.
The customer is obliged to only use the storage space provided by the provider for legal content. The provider reserves the right to block access to illegal content.
4. Remuneration and Terms of Payment
The remuneration for the provider's services is specified in the provider's valid price list. All prices are exclusive of statutory VAT. Payment is made either by bank transfer in advance or by direct debit. If the customer defaults in payment, the provider is entitled to block access to the services until full payment has been made.
5. Liability
The provider is liable for damage caused by the provider, his legal representatives or vicarious agents intentionally or through gross negligence, in accordance with the statutory provisions. In the case of slightly negligent breaches of essential contractual obligations, the provider is only liable for the foreseeable contract
6. Privacy
The provider undertakes to observe the data protection regulations and to ensure the protection of the customer's personal data. The provider's data protection declaration is part of these terms and conditions and can be viewed on the provider's website.
7. Term and Termination
The contract between the provider and the customer is concluded for the agreed contract period. The contract is automatically extended by the agreed contract period if it is not terminated by one of the parties in due time. The notice period is one month to the end of the contract period. The termination must be in writing.
8. Severability
Should individual provisions of these General Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected. In place of the ineffective provision, an effective provision that comes as close as possible to the purpose of the ineffective provision shall apply.
